Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause physical harm to employees in that an employees were exposed to the hazard of crushing injuries associated with the rollover of a lift truck without the use of an operator restraint system: (a)Welding Bay: On April 29, 2010 an employee was observed operating a Toyota fork lift (model number 42-6FGCU20) without the use of the installed seatbelt. Abatement Note: Among other methods, feasible and acceptable abatement menthods to correct this hazzard are: (1)ASME B56.1-1993 Safety Standard for Low and High Lift Trucks requires the usage of an operator restraint system at all times.
