Section 5(a)(1 of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were likely to cause death or serious physical harm to employees
exposed to a fall
hazard from an excavator bucket:
(a)Rock Branch Community Bank - Nitro, WV:  On or about July 1, 2010 an
employee of Dana Casto Construction was seen standing on the bucket of a
Kobelco hydraulic excavator Model SK115-SRDZ while the bucket was lifted
out of a trench exposing the employee to an unprotected fall distance of
up to
ten feet to the bottom of the trench.  Among other methods, one feasible
and
acceptable abatement method to correct this hazard would be to follow 29
CFR
1926.651(c) and/or the recommendations outlined in the Construction
Industry
Manufacturers Association Safety Manual for Hydraulic Excavators which
states to never allow anyone to ride the attachment or load of an
excavator.
