Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard which could inflict death or serious injury while transferring granite slabs from delivery trucks to storage racks and from storage racks to the fabrication shop: (a)Home Design Gallery at 3455 W. "F" St. #7 in Greeley, CO: On July 21, 2009 the employer allowed an employee to shift the weight of granite slabs on a storage rack onto his leg in order to move a granite slab with a forklift attachment. This exposed the employee to a crushing injury. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement Certification Letter"). Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to perform the following: A slab wedge can be used to separate the granite slabs from one another by having two employees stand to the side of the slab and insert the wedge so that a clamping device can be placed onto the slab to be moved. Employees should be trained never to stand in the fall shadow of the granite slab while transporting it. Employees must be prohibited from bracing slabs against any part of their bodies.
