Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: (a)Brinkmann Constructors at 4827 S. Wadsworth Way, Littleton, CO 80123: On or before 09/11/09, the employer permitted employees to load a forklift in an unsafe and unstable manner when removing roof-top unit (RTU) materials from the rooftop. Condition exposed employees to the hazard of getting struck by falling debris. Abatement Note: Abatement certification is required for this item (See enclosed "Sample Abatement-Certification Letter"). Among other methods, one feasible and acceptable abatement method is referenced in ANSI B56.6 - 2005 by the Industrial Trucks Standards Development Foundation, Section 6.4.3: "Handle only stable or safely arranged loads."
