Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to each of his employees employment and a place of employment
which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to a fire hazard:
(a) Nestle Purina Petcare, 4555 York St., Denver, CO 80216: On or before
10/30/09, the employer did not ensure that employees were protected from a
fire and
explosion hazard when a Bin Whip (#9250-H-110-12) contacted and wrapped up
a
Daniel Woodhead light (#4YJ40) thus resulting in a flash fire in Bin 13.
This
condition exposed employees to hazards including, but not limited to,
burns.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to:
(1) Ultilize approved lighting from a location outside of the bin which
would
not be
exposed to contact with the bin whip.
Abatement note: Abatement certification and documentation is required for
this item (see
enclosed "Sample Abatement-Certification Letter").
