Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to being struck-by vehicular traffic:
(a)Denver Sign Systems, Inc., & 14th Street & Arapahoe Street, Denver,
CO: On or before October 23, 2009, the exposing employer did not ensure
that each employee performing sign installation activities within the
workzone
was wearing warning vest or other suitable garments marked with or made of
reflectorized or high-visibility material. Although no speed limit signs
were
posted, the motor vehicles travelled at approximately 30 to 35 mph. This
condition exposed employees to the hazard of being struck-by moving
vehicles.
Among others, one feasible and acceptable abatement method to correct this
hazard is
to ensure that each employee who works in traffic work zones wears
suitable
warning
vests such as those that meet the specifications for reflective materials
required in
ANSI/ISEA 107-2004 STANDARD. Chapter 6D.- Pedestrian and Worker Safety as
delineated in the Manual on Uniform Traffic Control Devices (MUTCD), 2003
Edition (Section 6D.03B Worker Safety Apparel) requires the use high
visibility
apparel such as those that meet ANSI/ISEA 107-2004 Standard for High
Visibility
Safety Apparel for risk exposure Class 2 or 3. Furthermore, a competent
person
designated by the employer is to be responsible for the worker safety plan
within the
activity area of the job site and should make the selection of the
appropriate class
garment.
