Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a potential fall hazard associated with securing attachments to the carriage of the rough terrain forklift: (a)All Star Roofing dba All Star Exteriors, Inc. & 11160 Huron St., Northglenn, CO 80234: On and before November 5th, 2009 the employer did not ensure that the connection from the carriage of the rough terrain forklift to the self-dumping hopper was sufficient to avoid the hopper from disconnecting. The employer utilized a 2" ratchet strap to secure the self- dumping hopper to the carriage of the forklift. The safety chain intended to secure the hopper to the forklift, was damaged. This condition exposed an employee to a fall hazard of approximately 20 feet. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow ASME/ANSI B56.6 requirements associated to lifting personnel: Among other methods, one feasible and acceptable abatement method can be found in ASME/ANSI B56.6-1992, The American Society of Mechanical Engineers- An American National Standard- Safety Standard for Rough Terrain Forklift Trucks, paragraph 6.4 Loading-Section 6.4.4, instructs operators: "When attachments are used, extra care shall be taken in securing, manipulating, positioning, and transporting the load. Among other methods, one feasible and acceptable abatement method can be found under Star Industries before use instructions. The manufacturer instructs operators under 1., Inspect Hopper before each use and transporting with a forklift. Check latch assembly and drum rotation components for damage or excessive wear. Replace latch spring if broken. Replace any other damaged or missing parts. Carefully inspect drum and base for broken welds or damage. Make sure hopper is operating properly. If any abnormality is found, discontinue use until proper repair has been made or it is determined the defect does not affect the safe operation of the hopper.
