Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling hazards and crushing hazards as a result of riding in the bucket. (a)Mendez, Inc. & 32 Road Sewer Project, Grand Junction, CO 81503: On and before May 12th, 2010, the exposing employer did not ensure employees were not utilizing an excavator's bucket as a means of accessing and egressing the excavation. Employees were riding within the excavator bucket to gain access to an excavation to install sewer pipe within an excavation approximately 21 feet in depth. This condition exposed an employee to the hazard of falling approximately 21 feet, to being struck by the bucket, and caught-in-between hazards associated with the moving parts of the excavator bucket. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow SAE J153, Surface Vehicle Recommended Practice, Section 4.3 Operator-General Precautions, instructs operators: "Do not permit riders on the machine if there is no manufacturer's designated place for a rider." Abatement Note: Abatement certification and documentation are required for this item (see enclosed "Sample Abatement Certification Letter").tion
