Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of struck by motor vehicles:
a)  Colorado Soda Blasting, LLC., Carlson Farms, Johnstown, CO: The
employer did not ensure that appropriate high-visibility apparel was
provided and
used while working near road traffic. On or about 6/14/2010, an employee
was
observed using an abrasive blasting agent (sodium bicarbonate) to remove
asphalt
residue material from several linear feet of concrete curb and gutter
without high-
visibility safety apparel.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard would be to adopt section 634 of the Federal Highway
Administration's 23 Code of Federal Regulations (CFR). Section 634 titled
"Worker Visibility" states that all workers within the right-of-way who are
exposed either to traffic or construction equipment within the work area
shall
wear high-visibility safety apparel.
