Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the rotating saw blade : (a) Band saw Area, East Wall - the Grob vertical band saw, used to cut metal parts, was not equipped with a magnetic restart or equivalent device. The saw was last used on or about June 2, 2009. Among other methods, one feasible and acceptable method to correct this hazard includes but not limited to the following: Conform to ANSI the American National Standards Institute for Safety Requirements for Metal Sawing Machines, ANSI B11.10 - 2003, Section 6.11 which states" The machine controls shall incorporate a type of drive motor starter that will disconnect the drive motor from the power source in the event of the control voltage or power failure system failure" and National Fire Protection Association - NFPA 79 -2007, Section 7.5.3 "Upon restoration of the voltage or upon switching on the incoming supply, automatic or unintentional restarting of the machine shall be prevented when such a restart causes a hazardous condition." In accordance with 29 CFR 29 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.
