Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazard that were causing or were likely to cause death or serious harm to employee in that employees were exposed to being struck by a back hoe excavator: (a) Along Barclay Street - Accessible area(s) within the swing radius of a Komatsu excavator were not barricaded in such a manner as to prevent employees from being struck or crushed by the excavator; on or about 06/18/09. One Feasible and Acceptable Abatement Methods, Among Others, To Correct The Hazard is to follow the Association of Equipment Manufacturers Hydraulic Excavator Safety Manual and barricade the swing radius to the sides and rear of the excavator's superstructure to prevent employees from entering the area.ing
