Nevada Revised Statute 618.375(1):  Duties of employers.  The employer
failed to furnish
employment and a place of employment which was free from recognized
hazards that were
causing or likely to cause death or serious physical harm to his employees:
The employer failed to provide a place that was free from recognized
hazards that were likely
to cause death and serious physical harm to employees as follows:
a.Two employees performing electrical duties were changing out lighting
fixtures
at the ceiling of a warehouse at the Southern Desert Correctional Center
located
in Indian Springs, Nevada. The employees were performing the work from a
JLG
lift, model #450A, at an approximate height of 20 feet when the operator
drove
the vehicle over diamond plates covering a drainage trench. The weight of
the lift
caused the plates to collapse, sending the tires for the left side of the
lift into the
16-20 inch deep trench. The change in position pinned one employee (#1)
between an I-Beam on the ceiling and the rail around the basket.  The other
employee (#2) sustained severe arm lacerations and muscle detachment,
presumably from impact with the beam on the ceiling as well.
Employee #1 was transported to University Medical Center (UMC) via Flight
for
Life, and the second employee was transported to the same via ambulance.
Employee #1 sustained chest injuries and was pronounced at the hospital
following attempts to resuscitate. (Approximately 11:10 a.m.) Employee #2
was
taken into surgery and was hospitalized following.

7.8 Work Place Inspection
Before the aerial platform is used and during use, the user shall check
the area
in which the aerial platform is to be used for possible hazards such as,
but not
limited to:
1) Drop-offs or holes, including those concealed by water, ice, mud, etc.
7) Inadequate surface and support to withstand all load forces imposed by
the
aerial platform in all operating configurations.
Feasible abatement would be to follow the requirements of ANSI/SIA A92.5 -
2006.
