Nevada Revised Statute 618.375(1): Duties of employers. The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: The employer did not ensure that its place of employment was free from recognized hazards, as follows: a)In two Fabrication shops, employees worked with multiple press brakes. The employer did not establish a program of regular and periodic inspections of the press brakes to ensure that all of their parts, auxiliary equipment and safeguards are in safe operating condition and adjustment. Employees were exposed to potential malfunctioning of the press brakes due to lack of inspections. Reference: ANSI B11.3-1992, para. 5.1.4: "INSPECTION AND MAINTENANCE RECORDS. It shall be the responsibility of the employer to establish and follow a program of periodic and regular inspections of his power press brakes to ensure that all their parts, auxiliary equipment, and safeguards are in safe operating condition and adjustment. The employer shall maintain records of these inspections and the maintenance work performed of these inspections and the maintenance work performed as required for normal business operations." A feasible means of abatement would be to follow develop and implement a press brake maintenance program in accordance with the American National Standard Institute, B11.3-1992 standard.2
