Nevada Revised Statute 618.375(1):  Duties of employers.  The employer
failed to furnish
employment and a place of employment which was free from recognized
hazards that were
causing or likely to cause death or serious physical harm to his employees:
The employer failed to ensure automotive lifts in the shop were properly
maintained and
operated, as follows:
a.The employer did not have operator training documentation for employees
using
Challenger automotive lifts,  as required by ANSI/ALI ALOIM-2008 paragraph
4.3:  The owner or employer shall appropriately document operator training
by completing the operator training log found in the appendix to this
standard.
b.The employer did not provide safety warning labels for 6 Challenger
automotive
lifts, as required by ANSI/ALI ALOIM-2008 paragraph 4.4.4(2):  The lift
owner or employer shall take all appropriate steps to follow the
recommended
inspection procedures of the lift manufacturer, but in no event shall the
lift
operator fail to inspect or take notice on a daily basis of the
accessibility and
readability of safety warning labels.
c.The employer did not ensure that capacity plates on two automotive lifts
were
readable as required by ANSI/ALI ALOIM-2008 paragraph 4.4.4(3):  In no
event shall the operator fail to inspect or take notice on a daily basis
of the
readability of the rated load capacity of the lift.
d.The employer did not stop using 4 Challenger automotive lifts after lift
leg
contact pads were worn off.  ANSI/ALI ALOIM-2008 paragraph 4.4.4(7)
required the lift operator to inspect on a daily basis damage or excessive
wear
on any of the lift contact point which engage the vehicle during lifting,
whether they engage the tires, frame, body or axles.  Paragraph 4.5
required:
If any of the conditions described above are observed, the operator shall
stop
using the lift.  Employees were exposed to serious broken bone injuries
from
vehicle slippage at lift leg contact points.  Abated during inspection.
e.The employer did not establish a periodic planned maintenance procedure
as
required by ANSI/ALI ALOIM-2008 paragraph 6.1.1:  The owner or
employer shall establish a periodic planned maintenance procedure in
accordance with the recommendations of the lift manufacturer in order to
ensure reliability and allow the continued safe operation of the lift.
Abated
during inspection.
One feasible means of abatement would be to follow the requirements of
ANSI/ALI ALOIM-
2008 in order to ensure reliability and allow the continued safe operation
of the lift.
