Nevada Revised Statute 618.375(1):  Duties of employers.  The employer
failed to furnish
employment and a place of employment which was free from recognized
hazards that were
causing or likely to cause death or serious physical harm to his employees:
The employer did not ensure that fall protection was used as follows:
a.At the Value Place project, an employee was using a Genie S-60 Aerial
Lift to
transfer materials from the ground floor to the roof.  The employee was not
wearing fall protection as required.

Section 7.3.3 Pre-Start Inspection: Before use each day or at the
beginning of
each shift, the aerial platform shall be given a visual inspection and
functional test
including but not limited to the following: (c) Personal protection
devices,
including fall protection.
Section 8.8 During Operation:  The aerial platform shall be used in
accordance
with this standard.  The operator shall ensure the following before each
elevation
of the platform: (g) Ensure all personnel in the platform are wearing fall
protection devices and other safety gear as required at all times.
One feasible means of abatement is to make sure that personal fall
protection
equipment required to do the job is provided and utilized.

The employer did not ensure that an employee was trained as follows:
a.Located at the Value Place construction site, an employee was using a
Genie A-
60 aerial lift to move roof tiles from the ground to the building roof.
The
employee was not trained to operate the equipment and was exposed to
serious
fall hazards of approximately 20 feet.

Section 6.10 Operator Training:  Whenever an owner directs or authorizes
an individual
to operate an aerial platform, he shall ensure that the individual has
been trained in
accordance with the manufacturer's operating manual and requirements
listed
in section
6 of this standard before operating the aerial platform.
Section 7.7(a) Before Operation:  Before authorizing an operation to
operate an aerial
platform, the user shall ensure that the operator has been instructed by a
qualified person
in the intended purpose and function of each control.
One feasible means of abatement is to make sure that the operator of the
aerial platform
has been trained in accordance with the manufacturer's operating manual on
how to
properly operate the aerial platform.
