Nevada Revised Statute 618.375(1):  Duties of employers.  The employer
failed to furnish
employment and a place of employment which was free from recognized
hazards that were
causing or likely to cause death or serious physical harm to his employees:
The employer failed to ensure personnel were elevated safely, as follows:
a.At the Sarann Knight Apartments construction site, northeast exterior
stairwell,
steel stairwell construction activities, employees were exposed to 24 and
12 foot
falls while working from a personnel platform that was not securely
attached to
the lifting carriage or forks of a rough terrain forklift. The employer was
elevating the employees on two separate occasions. On the first instance,
the
personnel platform was occupied by two employees while it was elevated to
24
feet above ground. The platform was being elevated by the endpockets of the
platform, which were to be used for transportation loading only, as was
stated on
a decal located on the platform. By placing the forks into the endpockets
rather
than the attach pockets designated by the manufacturer, the platform's
chains and
pins could not be used to attach the platform securely to the forklift's
lifting
carriage or forks. Five days later, two employees were exposed to a 12
foot fall
while working from the same platform attached to the same forklift in the
same
manner.

Safety Standard for Rough Terrain Forklift Trucks
Section 5.15, Paragraph (b) Elevating Personnel: Be certain that the
platform
is securely attached to the lifting carriage or forks.
One feasible means of abatement is to ensure forklift operators read all
safety
manuals and decals pertaining to rough terrain forklift attachments prior
to their
use.
b.At the Sarann Knight Apartments construction site, steel stairwell
construction
activities, employees were exposed to a 12 foot fall while working from a
personnel platform elevated by a rough terrain forklift whose operating
position
had been abandoned by the forklift operator. The operator had walked off
with
his back turned to the forklift and elevated workers without blocking the
wheels
of his forklift. In addition, the front end of the forklift had been
parked on a
berm, or raised barrier that caused the forklift to rest on a slope, which
created
the potential for the forklift to roll backwards while the platform was
occupied
by workers.

Safety Standard for Rough Terrain Forklift Trucks
Section 5.15, Paragraph (s) Elevating Personnel: A trained operator shall
be
in position to control the rough terrain forklift truck or available to
operate
controls if the platform is not equipped with controls. When the operator
is not
in the operating position, block the truck wheels and apply the parking
brake
with all travel controls in neutral.
One feasible means of abatement is to ensure the forklift operator
successfully
completes a refresher training course in rough terrain forklift safety.
