Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about 06/15/09; During construction activities; The bucket of the New Holland 650E Excavator was used to transport employees from one job site down the street to another job site. Amoung other methods, feasible and acceptable abatement methods include, but not limited to the following: a. Follow the Equipment Manufacturers Institue safety manbual for operators and mechanics of hydraulic Backhoe/Loaders which states "Never use a bucket for a work platform or personnel carrier" and b. Follow the New Holland Operators manual for a 650E which states "Your Backhoe/Loader is a ONE-PERSON Machine. NEVER PERMIT RIDERS.
