North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees conditions of employment
and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to
employees in that employees were exposed to struck-by hazards as a result
of being in the danger zone:
a)barge on Lake Norman, on June 16, 2009, an employee was standing in
close proximity to a
30-foot, 3000-pound metal pole (spud) as it was being lifted by a Case
CX210 excavator.
When the spud inadvertently cleared the well, it fell forward, striking
the employee.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to
position the employee to the rear of the excavator until the spud was
stabilized in the well.lized

employees in that employees were exposed to struck-by hazards as a result
of improper rigging:
a)barge on Lake Norman, on June 16, 2009, an Ashley 7/8" wire rope sling
was used to lift a 30-foot, 3000-pound pole (spud) prior to moving the
barge.  The sling was rigged only five feet
from the bottom of the spud, creating an unbalanced load when it was
lifted from the well.  The
top-heavy spud fell to the barge, striking an employee on the head.
Among other methods one feasible and acceptable abatement method to
correct this hazard is to
lift the spud by using the T fitting at the top of the spud, or by rigging
the load at or above the
center of gravity of the spud, helping the operator to maintain control of
the load.
