Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being struck by falling vehicle lifts: a)All eight (8) of the car lifts are in need of replacement or major repair. b)There were no maintenance records available for any of the lifts at the time of the inspection. Employees believe the lifts have not been replaced in 25 years. c)The lifts in bays #1, #5, #7 and #8 according to employees and compliance officer observation need to be replaced. d)None of the eight (8) bays (lifts) in the repair shop have safety latches. Each lift should have two safety latches. Therefore, there are 16 safety latches missing from the lifts. e)Lift #1 has very bad seals. The rack moves from side to side while going up. There are wet spots from where the oil leaks onto the floor. f)Lift #5 is in bad condition. It drops down all the time. The pistons are coming through the top of the rack and the rack has blown out seals. g)Lift #7 or the truck lift has a stability arm that is completely broken. The arm swivels around and is not stable. According to the American National Standard jacks should be inspected frequently and jacks shall be operated at 100 percent of their load (ANSI B30.1-1975). Among other feasible and acceptable methods to correct these hazards would be to completely repair all eight (8) car lifts. Upon the completion of these repairs, the employer should start a preventive maintenance program for all car lift and jacks used in this facility. The employer should keep a written log to record all inspections and repairs made to all tools and equipment used in the repair shop. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citation(s).
