Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm in
that employees are
exposed to the conditions listed below:
Bravo Cadillac: On 08/24/2010, and times prior thereto, employees were
exposed to crushing
and amputation hazards while working in the maintenance bays of the
facility. The employer
is failing to protect employees utilizing hydraulic automobile lifts from
crushing and
amputation hazards due to the safety arm locking devices not available,
cables are stretched
and with a sign of fatigue (washers are being used as shims to achieve
balance) and the
safety shut off does not operate. The employer has made modifications to
the automotive lifts
without the expressed written permission of the manufacturer.
The most feasible and acceptable method of abatement is to strictly
enforce
a preventive
maintenance program according to the manufacturer's (Challenger Lift
Division/VBM
Corporation) specifications page # 25, and ANSI/ALI ALOIM-2000 Standards
for
Automotive Lifts Safety Requirements for Operation, Inspection and
Maintenance.
