Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees riding the aerial tramway and gondola were exposed to fall hazards. On or about March 17, 2011 and at times prior thereto, the employer did not ensure that the gondola used with the aerial tramway system was certified and inspected properly. Employees using the gondola to access the communication station on top of the Franklin Mountains were exposed to fall and struck by hazards in the event of equipment failure or damage. Feasible abatement methods to correct this hazard may include, but are not limited to, developing or better documenting preoperational and annual inspections. Pursuant to 29 CFR 1903.19 within ten (10) calendar days of the abatement date, the employer must submit documentation describing the actions it is taking to establish, communicate, and implement written procedures to ensure the integrity of the installation, operation and maintenance of the aerial tramway.nce
