Section 5 (a) (1): The employer failed to keep the workplace free from a hazard, likely to cause death or serious physical harm to employees who were exposed to an impalement hazard. Construction site: On or about October 19, 2010, at the THADD Organ Storage Building employees were exposed to an impalement hazard while working around two fully threaded rods that were not covered or protected. The rods projected approximately six inches above its foundation. Among other methods, one feasible and useful method to correct the hazard would be to install protective devices (covers or wooden troughs) for rebar that are capable of withstanding at least 250 pounds would be considered an appropriate performance criterion for impalement protection devices for other sharp objects as well.
