Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an impalement hazard. Construction site: On or about October 19, 2010, behind the THADD Building; employees were exposed to an impalement hazard while working around a metal conduit protruding not covered or protected. The metal conduit projected approximately 12 inches above the ground. There was a feasible and useful method to correct the hazard: Protective devices (covers or wooden troughs) for rebar that are capable of withstanding at least 250 pounds would be considered an appropriate performance criterion for impalement protection devices for other sharp objects as well. Construction site: On or about October 19, 2010, behind the THADD Building, employees were exposed to an impalement hazard while working around a metal conduit that was protruding not covered or protected. The metal conduit projected approximately 12 inches above the ground.
