Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to dust explosion, deflagration and other fire hazards from improper combustible dust clean-up methods: a) On or about July 21, 2009, compressed air, at or over 30 psi, was used to blow accumulated combustible wood dust off surfaces such as overhead pipes, beams and light fixtures and all ignition sources had not been eliminated from the area. Among other methods, one feasible and acceptable abatement method to correct this hazard includes compliance with the National Fire Protection Association (NFPA) Standard for the Prevention of Dust Explosions in Woodworking and Wood Flour Manufacturing Plants No. 664 (2007 edition) Section 11.2.1, including but not limited to discontinuing the use of compressed air or reducing the compressed air to 15 psi, vacuuming or using a natural bristle brush prior to blow off, and removing all ignition sources including the diesel powered Toyota fork lift with the designation unit D (which was used to lift employees up to reach the overhead fixtures) from the Class II Division II area.
