Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to run over and collision hazards: a)On June 24, 2009, at the site located at 1111 Chicago Avenue in Evanston, Illinois 60201, employees of Glander Paving Co. were working without high visibility safety apparel while performing paving tasks within its active roadways. Feasible means of abatement to the hazards would be to 1) Follow Chapter 6D Pedestrian and Worker Safety as delineated in the Manual on Uniform Traffic control Devices, 2003 edition (Section 6D.03B Worker Safety Apparel) and 2) Use high visibility apparel such as vests that meet ANSI/ISEA 107-2004 Standard for High Visibility Safety Apparel and Headgear for risk exposure Class 2 or 3. **In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).**
