Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a)Employees were exposed to a fall hazard of approximately 28 feet while climbing over the top rail of a JLG 3246ES scissors lift. A feasible means of abatement would be to comply with American National Standards Institute (ANSI) A92.6-1999 Self-Propelled Elevating Work Platforms which requires workers to maintain firm footing on the platform floor while working thereon and states that climbing by occupants on the midrail or top rail of the aerial platform is prohibited. Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
