Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that:
Employees were exposed to fall hazards when riding a material conveyor.
(a)On September 9, 2009, at 586 Farmstead Drive in Slinger, Wisconsin, an
employee(s) was riding the conveyor to access and descend from a
residential roof where they were stacking shingles.  The employee(s) was
exposed to a fall hazard of approximately 19 feet above the ground and
was not using any fall protection.
Among other methods, feasible and acceptable means to correct these
hazards are to use
safer alternate methods such as:
(1)Following the American National Standards Institute, ASME B20.1 Safety
Standards for Conveyors and Related Equipment, Operations, Section
5.12, as applicable.
(2)Follow the instructions stated in the Cleasby Conveyors Inc.,
Instruction
Manual for truck mounted conveyors, Conveyor Uses section as
applicable.
(3)Utilize a ladder which is designed for the purpose.
Certification, with date and method of abatement required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.ment
