Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to activated carbon dust explosion, deflagration or other fire hazards: (a)The Torit dust collector was inside the building and did not have explosion protection systems. (b)There was no deflagration isolation to prevent deflagration propagation from the Torit dust collector into the work area. (c)Air exhausted from the Torit dust collector and potentially contaminated with combustible dust from the Torit dust collector was recirculated into the building. Feasible abatement methods include complying with Chapter 7 of NFPA 654, Prevention of Fire and Dust Explosions from the Manufacturing, Processing, and Handling of Particulate Solids, such as but not limited to: (1) moving the Torit dust collector to a safe outdoor location; (2) installing explosion protection systems on the Torit dust collector; (3) installing deflagration isolation systems on ductwork such as abort gates; and (4) discharging air exhausted from the Torit dust collector to a safe outdoor location. Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
