Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a)At 2540 North Calhoun Rd., Brookfield, WI 53005, employer did not ensure that an employee was available to operate the JCB Loadall Model 532 rough terrain forklift while other employees were working on a platform attached to a rough terrain forklift. Employees were exposed to a struck-by hazard and a fall hazard. (b)At 2540 North Calhoun Rd., Brookfield, WI 53005, a Star Industrial work platform (45 1/2 x 12'1") was too long when attached to a JCB rough terrain forklift exposing employee to a fall hazard. Among other methods, feasible and acceptable means to correct these hazards are to: (a)Ensure a trained operator is in position to control the rough terrain forklift truck or available to operate the controls in accordance with the American National Standard, Safety Standard for Rough Terrain Forklift Trucks, ASME B56.6a- 2005 Section 5.15(s). This section states: a trained operator shall be in position to control the rough terrain forklift truck or available to operate the controls if the platform is not equipped with controls. When the operator is not in the operating position, block the truck wheels and apply the parking brake with all travel controls in neutral. (b)Use a safer alternative method such as using a platform which is designed in accordance with the American National Standard, Safety Standard for Rough Terrain Forklift Trucks, ASME B56.6a-2005 Section 8.24.1(b). This section states: floor dimensions shall not exceed two times the load center distance listed on the rough terrain forklift truck nameplate, measured parallel to the longitudinal center plane of the truck, nor have a width greater than the overall width of the truck [measured across the load bearing tires plus 10 inches (250mm) on either side]. Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
