Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to fall, struck-by and crushing hazards:
(a)The work platform attached to the Pettibone Model 8044 rough terrain
forklift
was not free from tipping while employees were conducting rough carpentry
on
a residential building in that the platform extended more than 10" on
either side
of the wheels of the rough terrain forklift. Employees were exposed to
crushing,
struck-by and fall hazards.
Among other methods, feasible and acceptable means to correct these
hazards are to use a safer
alternative method such as using a platform which is designed in
accordance with the American
National Standard, Safety Standard for Rough Terrain Forklift Trucks, ASME
B56.6a-2005
Section 8.24.1(b). This section states: floor dimensions shall not exceed
two times the load
center distance listed on the rough terrain forklift truck nameplate,
measured parallel to the
longitudinal center plane of the truck, nor have a width greater than the
overall width of the
truck [measured across the load bearing tires plus 10 inches (250mm) on
either side].
Certification, with date and method of abatement required.
Certification of abatement is required by 29 CFR Part 1903 and is to be
submitted within ten (10)
calendar days after the abatement date.ment
