Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: they are exposed to crushing hazards. Employees were exposed to crushing hazards when utilizing the automotive lift in bays #2 and #5 in that: (a)The employer failed to ensure that the safety latch on the lift in bay #5 was operating properly. This exposed employees to crushing hazards. (b)The employer failed to ensure that the pneumatic system which controls the front and rear pneumatic jacks were operating correctly. This exposed employees to crushing hazard when the lift would operate without being actuated by controls. (c)The employer failed to institute an inspection schedule for the automotive lifts to ensure that they were proper working order. This exposed employees to crushing hazards from the malfunctioning lifts. Among other methods, feasible means of abatement by which the hazards may be corrected are as follow: Automotive Lift Institute ALI-90: Inspect your lift daily. Never operate if it malfunctions or if it has broken or damaged parts. Repairs should be made with original equipment parts. Automotive Lift Institute ALOIM-1994, Section 4.4.4 The lift owner or employer shall take all appropriate steps to follow the recommended inspection procedures of the lift manufacturer, but in no event shall the lift operator fail to inspect or take notice of the following features on a daily basis: (1)accessibility of the operating procedures, safety tips and generic safety material; (2)accessibility and readability of safety warning labels; (3)the rated load capacity of the lift; (4)proper operation of the lift controls, restrains and locking devices; (5)deformation or excessive wear of any of the lift structural components; (6)deformation or excessive wear of other components such as hoses, electrical wires, drive chains, cables or screws; (7)damage or excessive wear on any of the lift contact points which engage the vehicle during lifting, whether they engage the tires, frame, body or axles; (8)evidence of hydraulic or pneumatic leaks; (9)unusual noises, sudden movements, erratic operation or evidence of chips or filing during use; (10)cracks or loose concrete around floor anchor bolts, if employed.Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.
