Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while using a platform supported by a rough terrain forklift. (a)The EZ Scaff work platform (~12 feet wide) was too long when attached to the Gehl rough terrain forklift (~8 foot wheel width), exposing employees to a fall hazard. (b)The guard rails on the EZ Scaff platform were not installed, exposing employees to a fall hazard. (c)The operator to the Gehl rough terrain forklift was not on the same working level of the forklift, exposing employees to fall hazards. Among other methods, feasible and acceptable means to correct these hazards are to: (a)Ensure that the platform and rough terrain forklift are compatible for wheel width too platform width in accordance with American National Safety Standards for Rough Terrain Forklift Trucks, ASME B56.6-2005 Section 8.24.1(b). This section states: floor dimensions shall not exceed two times the load center distance listed on the rough terrain forklift truck nameplate, measured parallel to the longitudinal center plane of the truck, nor have a width greater than the overall width of the truck [measured across the load bearing tires plus 10 inches (250mm) on either side]. (b)Ensure that the guard rails for the platform are installed properly in accordance with American National Safety Standards for Rough Terrain Forklift Trucks, ASME B56.6-2005 Section 8.24.1(l) which states: restraining means such as a guard rail or means for securing personnel such as a body belt or lanyard. (c)Ensure that a trained operator is in position to control the rough terrain forklift truck or available to operate the controls in accordance with the American National Safety Standards for Rough Terrain Forklift Trucks, ASME B56.6-2005 Section 5.15(s). This section states: a trained operator shall be positioned to control the rough terrain forklift, or available to operate controls if the platform is not equipped with controls. Certification, with date and method of abatement required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
