Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: (a)Production area, employees were operating a Cincinnati shear, Serial No. 20937, by a foot treadle. The springs for the operation of the foot treadle were replaced with black rubber bungee cords. This exposed the operator(s) to struck-by hazards. (b)Production area, employees were operating a Cincinnati shear, Serial No. 20937, by a foot treadle that was not guarded from falling, moving objects or unintended operations. This exposed the operator(s) to struck-by hazards. A feasible means of abatement would be to comply with the American National Standards Institute (ANSI) B11.4 Safety Requirements for Shears, Section 8 Safeguarding and Section 9 Set-up, Operation and Maintenance as applicable. Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
