Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees a place of employment which was free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of falling from elevation, to the
next level while walking
on the oversize platform raised on the forks of a Sky Track Telescopic
fork lift:
Southeast side of the building under construction employees were
installing roof
insulation and sheeting while using a job made platform attached to the
forks of a Sky
Trak model number 8042. The employer did not ensure that the platform was
designed
and approved by the manufacturer and therefore, exposing employees to fall
hazard of
approximately 25 feet to the next lower level.
Among other methods, feasible and acceptable means to correct the hazards
are
to use
a safer alternate method such as the use of a platform designed and
approved by the
manufacture meeting the requirements of the "American National Standards
Institute".
ASME/ANSI B56.6 2002, Safety standards for Rough Terrain Forklift Trucks
section
8.24.1(f) it states that "labeling on the man made platform should have
information
prominently indicated on the platform (1) maximum work load including
personnel and
equipment; (2) weight of empty platform.
