Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a fall hazard when climbing over the toprail of the
scissor lift to access the roof
overhang of strip mall.
a) At the time of the inspection, two laborers were raised on scissor lift
to a height of 14 feet
7 inches. The following problem was found, referenced in American National
Standards
Institute/SAI A92.6-1999 section 7.10 titled Operator Warning And
Instructions, paragraph (9);
1. Employees did not maintain a firm footing on the platform; employees
climbed over the
toprail of the aerial platform to gain access to the roof.  The roof also
was an unguarded work
platform that posed a fall hazard to employees.
Among other feasible and acceptable methods to correct this hazard would
be to use the entrance
gate to the platform as an egress point or use a ladder to access the
roof.  Once workers have
proper access to the roof the employer can provide a means of fall
protection for workers.
Abatement certification and abatement documentation is required for this
violation.  The
documentation should include written verification of abatement, applicable
measurements or
monitoring results, and photographs or videos which you believe will be
helpful.  The abatement
certification sheet is enclosed with the citation(s).
