Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a fall hazard:
On July 29, 2009, at this establishment, an employee was observed sitting
on the
top cap of a stepladder while cleaning the ventilation screens on the
ceiling.  The
employee was exposed to a fall hazard approximately 6 feet to the floor
below.
Among other methods, one feasible and acceptable method to correct this
hazard
is to develop a policy on proper ladder usage to include, but not limited
to,
prohibiting the user from stepping, sitting,  or standing on a
stepladder's top cap
as recommended by American National Standard Institute standard A14.5-2000,
section 9.3.2(4).0,
