Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees in that:
a) In the area directly beneath the Dueling Dragons Ride known as "The
Compound",
employees performing foundation checks are exposed to the hazard of being
struck by
the carriage of the roller coaster.  Employees making these checks cross
under the
coaster tracks and through the path of the coaster, on or about 7/1/09.
b) In the area directly beneath the Dueling Dragons Ride known as "The
Compound",
employees responding to maintenance calls are exposed to the hazard of
being struck by
the carriage of the roller coaster. Employees responding to the calls
walk under the
tracks and cross the path of the coaster when moving within the compound,
on or about
7/1/09.
FEASIBLE AND ACCEPTABLE METHOD OF ABATEMENT WOULD BE TO:
One feasible means of abatement is to develop and implement a method of
performing the
"foundation checks" that does not expose employees to the carriage of the
moving roller coaster,
such as but not limited to, installing devices that will continually
monitor movement occurring
in the support structures while the ride is in motion, install safe zones
and barricades for
employees working in the compound.
