Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
provide employment and a place of employment which were free from
recognized hazards that
causing or likely to cause death or serious physical harm to employees in
that an employee was
exposed to the hazard of being struck by containers:
(a)Onboard M/V HYUNDAI HONG KONG, bay twenty one : A crane boss was exposed
to being struck by a falling or swinging container or its contents when he
was working
within eight feet of where a twenty foot container was loaded onboard the
vessel with a
crane.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO
CORRECT THE HAZARD:
1.Ensure employees are not allowed to walk or work in the aisles adjacent
to a container
bay being loaded or discharged. Reference: Pacific Coast Maritime Safety
Code, 2008
Revision, ILWU-PMA, Section 15, Rule Number 1513.
2.Ensure any longshoreman elevated to the position of crane boss is
provided with training
which would enable them to perform their duties in a safe manner.
