Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not provide employment and a place of employment which were free from recognized hazards that cause or likely to cause death or serious physical harm to employees in that an employee was exposed to the hazard of being struck by containers or their contents: (a)Onboard M/V HANJIN NAGOYA, bay forty six : A crane boss was exposed to possible injury from being struck by a falling or swinging container or it's contents when she was working within approximately eight feet of where the crane was loading container onboard the vessel. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THE HAZARD: 1.Ensure employees are not allowed to walk or work in the aisles adjacent to a container bay being loaded or discharged. Reference: Pacific Coast Maritime Safety Code, 2008 Revision, ILWU-PMA, Section 15, Rule Number 1513.
