Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck by wheel loader lifting arm or
bucket:
(a)Vessel CIELO DI MONFALCONE, hatch number five, Caterpillar 928G Wheel
Loader:
On or about August 10, 2009, employees were exposed to the hazard of being
crushed
in unsecured pinch point while  attaching the hoisting cables on the front
end of the
loader. Employees were allowed to work underneath the lifting arms and
bucket of the
machine.
One feasible and acceptable method to correct hazard is to prohibit
employees from getting
under the bucket and/or lifting arms of the front-end loader. If an
employee must work under
the bucket and/or lift arm ensure that it is adequately blocked and braced
with a stand or other
device to prevent unexpected movement.
Another feasible and acceptable method to abate the hazard is to make the
connections with the
bucket down and reaching over or around the tires.
Another feasible and acceptable method to abate the hazard is to make the
connection  from
under the payloader with the bucket down,  power turned off and emergency
brake set.
