Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free from
recognized hazards that were causing or likely to cause death or serious
physical harm to employees in that
employees were exposed to being struck or crushed by the automotive lift
and the load lifted in the event of a
failure:
a)establishment, maintenance area - employees operated a Hunter alignment
system lift (unable to
locate model and serial numbers) with a maximum weight capacity of 14,000
pounds (7,000
pounds per axle) to perform maintenance on customer's vehicles.   The lift
was not utilized,
inspected or maintained according to manufacturer's and other applicable
standards in that the
loads were lifts which potentially exceeded the maximum weight capacity,
routine inspections
were not conducted by a qualified inspector and preventive maintenance
procedures
were not
followed.
b)establishment, maintenance area - employees operated a Benwil automotive
lift,        Model
BW-9, SN H949580, with a maximum weight capacity of 9,000 pounds to
perform maintenance
on customer's vehicles.   The lift was not utilized, inspected or
maintained according to
manufacturer's and other applicable standards in that the loads were lifts
which potentially
exceeded the maximum weight capacity, routine inspections were not
conducted by a qualified
inspector and preventive maintenance procedures were not followed.
c)establishment, maintenance area - employees operated a Global automotive
lift, Model
ES9000A, SN 94AL0529,  with a maximum weight capacity of 9,000 pounds to
perform
maintenance on customer's vehicles.   The lift was not utilized, inspected
or maintained
according to manufacturer's and other applicable standards in that the
loads were lifts which
potentially exceeded the maximum weight capacity, routine inspections were
not conducted by a
qualified inspector and preventive maintenance procedures were not
followed.
