North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of em ployment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the potential of being struck by falling trusses due to a failure to follow the manufacturer's recommendation or the Building Component Safety Information (BCSI B1, B2, or B3) Guide to Good Practice for Handling, Installing, and Bracing of Metal Plate Connected Wood Trusses: a)jobsite - on or about Sept 8, 2009 when approximately thirty-seven (37) sixth-seven ft. long wooden scissor trusses collapsed inward into the building when the employer failed to ensure that the following manufactures's recommendations, Wood Truss Council of America (WTCA), and those of the BCSI 1-3 were not followed: (1)The employer failed to ensure that the top chord temporary lateral restraint spacing of four feet on center for truss spans of 60' to 80' was being maintained; and not at 13 feet on center. (2)The employer failed to ensure that the web member plane bracing spacing was set at 10 -15 feet on center using one w-brace which made the spacing of the restraint 33 ft. center to center exceeded the allowable spacing. (3)The employer failed to ensure that the bottom chord bracing of 10 - 15 feet on center using 2,4,12 feet members that only two brace were utilized making the spacing of the restraint between eave and first restraint 26 feet exceeding the allowable spacing. (4)The employer failed to follow the handout provide on "Long Span Truss Installation" of Wood Truss Council of America (WTCA) that highly recommended installing temporary center supports to reduce the stresses on the truss chords during erection; that is to install only a few trusses at a time then sheet, and not install all the trusses then sheet only one side before the other side. (5)The employer failed to follow the handout provided on "Long Span Truss Installation" of WTCA that required using 2x4's that were stress grade lumber with two nails at each end of the bracing, and not 1x4 construction grade lumber with one nail at each end to protect against rotation. (6)The employer failed to follow the handout in BCSI 1-3 that provided detailed requirements and instructions of bracing the gable trusses; the employer only braced four out of the nine gable trusses to the ground. [ Reference; Building Component Safety Information ( BCSI B1, B2, and B3), Guide to Good Practice for Handling, Installing, and Bracing of Metal Plate Connected Wood Trusses] ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard would be to follow the manufacturer's and the BCSI 1-3 recommendations.
