North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to falls in excess of 25': a)establishment - employees were exposed potential fall in excess of 25' when elevated in a railed pallet which was not secured to the powered industrial truck lifting carriage or forks. Among other methods of abatement, one feasible method would be to follow the guidelines laid out in American National Standards Institute/Industrial Truck Standards Development Foundation ANSI/ITSDF B56.1, Safety Standard For Low Lift and High Lift Trucks 2005 Edition).
