NCGS 95.129(a)(1) Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)facility, dust collection system area- Employer failed to ensure the dust collection system was to be located outside the facility. A feasible and acceptable method of abatement, among others, to correct this hazard is for the employer to move the dust collection system outside of the facility. An additional method of abatement is to equip the dust collection system with explosion venting.n
