Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: JBS USA, LLC, 5950 Trails End Road, Cactus, Texas. For the period of time up to and including April 13, 2010, the employer did not ensure that a safey device was operating on a SK 11-320 Townsend skinning machine. Employees performed work operations such as preventative maintenance (PM) when the machine caught his sleeve and pulled his hand through the machine roller. This condition exposed employee(s) to caught by hazards. Feasible and Acceptable Abatement Methods would include: Ensure that all safety devices are operable prior to performing preventative maintenance on the skinning machine. "Pursuant to 29 CFR 19103.19(d), the employer must provide documentation that this violation has been abted within 10 calendar days after the abatement date.ment
