Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught-in hazards while operating an LM25 Vermeer tractor equipped with a horizontal boring attachment: On 7/23/2009 an employee was caught in the rotating drill rod of Vermeer LM25 tractor #343 due to foot controlling of the boring rod. Among other abatement methods to correct this hazard, one acceptable method is to ensure boring operations are performed in accordance with the manufacturer's safe practices which include the following: do not guide drill rod with hands, arms, feet or other bodily contact. If guiding the drill rod is necessary, use proper guide tool(s) recommended in the manufacturer's operating manual.
