Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) For the employees who work around and under the Eagle automotive lift, Model TPO9, Serial Number 112597-RM-AP-17, that had a non-functioning motor switch and was missing the overhead over-travel safety located in the shop area at 1515 East Philadelphia Street, Rapid City, SD. (b) For the employees who work around and under the Eagle automotive lift, Model TPO12, Serial Number TPO12-05001-FNAA-009, that had a missing overhead limit switch and inoperative stops located in the shop area at 1515 East Philadelphia Street, Rapid City, SD. (c) For the employees who work around or under the Eagle automotive lift, Model TPO10A, Serial Number TPO10A-0601-FNRMB-018, that had missing rubber pads located in the shop area at 1515 East Philadelphia Street, Rapid City, SD. Abatement Note: Among other methods, one feasible and acceptable method of abatement would be to follow the requirements of ANSI/ALI ALOIM and/or ANSI B153.1 which includes, among other requirements, the following: 1. Institute a preventative maintenance program according to the manufacturers specification. 2. Provide training to employees on proper use and care of the lifts. 3. Ensure all lifts are rated and marked with their load capacity. 4. Schedule and complete all periodic and annual inspections. Abatement Note: Abatement certification is required for this item (see enclosed "Sample Abatement Certification Letter").
