Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that:employees were exposed to crushing hazard. (a)Shop Area - On or about 9/15/09 employees were allowed to operate a Yale forklift which did not have seat belts. Among other methods, a feasible and acceptable method of correction is to install a seat belt retro-fit package and require seat belts to be worn when the forklift is in operation.
