Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to struck-by hazards;
(a)On or about October 7, 2009 at Mueller Copper Fittings, a metal brace
was
removed and replaced in the roof trusses by raising and lowering the brace
on the
guardrails of the aerial lift.
Reference JLG Operation and Safety Manual, sub-section 1.3 that states,
"Do not carry
materials directly on platform railing. Contact JLG for approved material
handling
accessories"
Among others, one feasible and useful abatement method to correct the
hazard is to:
Use equipment designed for lifting or contact JLG for recommendations.
