Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that an employee was underneath a backhoe that was raised and supported by the outriggers and loader. No cribbing or blocks were placed under the backhoe to prevent it from being lowered onto the employee. (a)Hwy 43 North and Blackhawk Road, Kosciusko, MS - On or about October 21, 2009 an employee was underneath a Case 580L Turbo, Series 2 backhoe that was raised and supported by the outriggers and front bucket. The backhoe was not secured in the raised position by blocks or cribbing to prevent it from lowering onto the employee if the hydraulic system bleeds down. The operator's Manual for the Case 580M Turbo backhoe states "Securely block the machine or any component that may fall before working on the machine or component. If possible, use a back up or secondary blocking device, also." Although the referenced operator's manual is for the Case 580M turbo backhoe, according to a Case service representative the same safety measures will apply to the Case 580L Turbo, Series 2 backhoe.
